Appeals Court Sets January Hearing On Vermont Yankee Case

A federal appeals court has set a date in mid-January for oral arguments in a case that tests the limits of a state’s authority to regulate nuclear power.

The case involves the long-running attempt by the state of Vermont to close the Vermont Yankee nuclear plant.

Almost a year ago, Entergy Vermont Yankee won a lower court ruling that struck down a Vermont law that gave the Legislature a say in whether the plant could be re-licensed.

The state appealed, and oral arguments will be held on January 14 th at the 2nd Circuit Court of Appeals in New York City.

Meanwhile, Entergy is back in federal court seeking an injunction against the New England Coalition, an anti-nuclear group. The coalition has asked the state Supreme Court to order the plant shut down.

Entergy says it and the state agreed that Vermont Yankee could keep operating while the PSB reviews the request for a new state permit. Entergy has asked the federal court to order the New England Coalition to withdraw its motion.
