Judge refuses to dismiss second-degree murder charges against teen

An upstate New York judge has refused to dismiss second-degree murder charges against a 16-year-old accused of killing two friends in an alcohol-related crash.

Sixteen-year-old Dustin St. Andrews faces two counts of second degree murder as well as lesser charges.  The April 21 single-car crash on Route 22 killed 16-year-old Ticonderoga resident Shannon James and a 16-year-old from Enosburg Falls in VT.

Police say St. Andrew’s blood-alcohol level was 0.12%, above the .08% for legal intoxication.  They say St. Andrew was driving at speeds in excess of 130 miles and hour when the car left the road and overturned.
