Judge throws out old murder case for lack of evidence

A judge has dismissed an old murder case saying the lack of evidence would prevent a fair trial.

Sixty-five-year-old Kenneth Bailey was arrested two years ago on first-degree murder charges for the 1971 shooting of Richard Langlais who died two years later of complications.

Bailey’s lawyer had argued that because so much evidence was lost, and so many people related to the case had died, the case should be dismissed.

Vermont District Court Judge Christina Reiss agrees.

The judge says the court“seeks not to punish the state for an honest but egregious loss of evidence … but to fully safeguard the defendant’s constitutional right to a fair trial.”
