Vermont voters will have a chance to weigh in this fall on whether to rewrite part of the state constitution. Vermonters will decide on Election Day whether to give the Legislature the power to change the age at which judges must retire.
A provision in the current state constitution forces judges to retire at age 70. Supporters say with people living longer, it makes sense that the Legislature should set the age rather than the constitution. But critics worry the Legislature won’t be able to get rid of judges who aren’t performing well. The U.S. Supreme Court has held that states can force judges to retire.
