Pastor Appeals Order To Testify In Same-Sex Custody Case

A Virginia pastor is appealing an order that he testify about the escape of a woman who didn’t want to share custody of her daughter with her former Vermont civil union partner.

The attorney for Kenneth Miller said he did not plan to appeal a subpoena requiring Miller to testify.

But attorney Joshua Autry says he changed his mind yesterday and decided to ask the 2nd U.S. Circuit Court of Appeals to overturn the decision requiring Miller’s testimony.

Kenneth Miller was convicted in August of helping Lisa Miller and her daughter flee to Nicaragua rather than share custody with a Fair Haven woman.

The two Millers in the case are not related.
