The Bennington County state’s attorney is asking the Vermont Supreme Court to reconsider a decision that would free a man serving a 12- to 20-year domestic assault sentence.
The Supreme Court ruled earlier this month that the conviction of 45-year-old Michael Brillon should be dismissed because he was denied his right to a speedy trial.
Brillon was imprisoned for three years before he went to trial on a July 2001 domestic assault charge.
The court’s 3-2 decision prompted a harsh dissent from two justices who argued Brillon was responsible for the delays in his case.
State’s Attorney Erica Marthage says her office filed a motion to reconsider the case on Thursday.
