Prosecutors in Bennington want an assault suspect whose case went to the U.S. Supreme Court returned to jail.

Last month, the nation’s highest court ruled that the Vermont Supreme Court was wrong in ordering the release of Michael Brillon, who was convicted of assaulting a woman in 2004 but freed from prison last year because it took nearly three years for his case to get to trial.

On Wednesday, Deputy Bennington County State’s Attorney Christina Rainville filed a motion with the Vermont Supreme Court seeking to have Brillon taken back into custody. His lawyer says he’ll fight the motion.
