State says trooper justified in Proctor shooting

The Vermont Attorney General’s office says a state police trooper was justified when he shot and wounded a Proctor man during what was described as a violent gun battle last November.

The Attorney General office and Rutland County prosecutor both concluded that Sgt. Thomas Mozzer was legally justified when he shot and wounded John Walters in Walters’ home.

The incident began Nov. 19 when police were called by Walters’ wife, who said he was depressed and drinking and that she feared he was going to leave on his motorcycle.

Mozzer was the first trooper to arrive and he found Walters sitting on a bed holding a handgun. After a scuffle Walters pointed the weapon at Mozzer. The two fired multiple rounds.

Walters is now facing charges.
