It’s not clear when the Vermont Supreme Court will rule on a request to throw out criminal charges against two anti-war protesters who heckled a Bush administration official during a 2006 appearance in St. Johnsbury.

Boots Wardinski, of Newbury, and Michael Colby, of Worcester, were ejected from a St. Johnsbury Academy graduation at which then-national intelligence director John Negroponte spoke. They were charged with disorderly conduct.

But they say they didn’t substantially disrupt the ceremony and that their words come under the category of free speech, protected by the First Amendment.

The Vermont Supreme Court, which heard oral arguments in the case yesterday, didn’t rule on their appeal.

Colby says he and Wardinski are proud of what they did, and that they were arrested while exercising their right to free speech.
